Affiliate Terms

Last updated: August 12, 2026

These Affiliate Terms govern participation in the SurgeFPS affiliate program. They apply automatically on an 'as is' basis — no separate contract or signature is required. By promoting, sharing, or otherwise using your affiliate code or referral link, you accept these terms in full.

1. Acceptance & nature of the relationship

When we issue you an affiliate code, you become eligible to participate in the program. You accept these terms by any use of that code or your referral link — for example posting it, linking it, or telling others about it. No signature, countersignature, or written agreement is needed, and none will be provided; these published terms are the entire agreement between you and SurgeFPS regarding the program.

Participation is as an independent party. Nothing here creates an employment, agency, partnership, joint-venture, or franchise relationship. You have no authority to bind, make commitments for, or speak on behalf of SurgeFPS, and you are not entitled to any employee benefits.

2. Your affiliate code

  • Your code doubles as a discount code customers can apply at checkout and as the referral link (?ref=YOURCODE) that attributes sales to you.
  • The discount and commission rates, and the reward window, that apply to your code are shown in your account dashboard. Standard defaults are 20% off for the customer and a 25% commission to you, but the rates on your specific code govern.
  • Codes are for your own promotional use. You may not sell, transfer, or share your code for others to administer, and you may not register variations designed to impersonate SurgeFPS.

3. How commissions are earned

  • Your discount is new-customers-only and applies to a customer’s first purchase (their first month on a monthly plan, or their first year on an annual plan). Returning or previously-subscribed customers are not eligible, and the code will be rejected for them at checkout.
  • You earn commission on the net amount a referred customer actually pays on qualifying invoices, at your commission rate. “Net amount” means the amount SurgeFPS receives for the referred subscription after any discount and after refunds, and excluding taxes (such as VAT or sales tax) collected on the sale. Commission is not calculated on amounts that are refunded, and $0 invoices (such as trial starts) earn nothing.
  • Commission is recurring for a reward window measured from that customer’s first charge (default 12 months per referred customer, unless your code is set to a different window or to lifetime). After the window ends, that customer’s renewals no longer earn.
  • Self-referrals earn nothing. You cannot earn a discount or commission on your own account or purchases.
  • If SurgeFPS is running a site-wide promotion when your customer checks out, the promotional discount may be applied instead of yours where it is the larger saving. This does not affect your commission — the sale is still attributed to you and paid at your normal rate.

4. Holds, refunds, and reversals

  • Each commission is subject to a 30-day hold before it becomes payable. This buffer lets refunds and most chargebacks resolve before any money is sent.
  • If a referred payment is refunded, the related commission is reduced in proportion to the refunded amount. A full refund removes it entirely.
  • If a referred payment is charged back or disputed, the related commission is reversed.
  • If a refund or chargeback occurs after a commission has already been paid to you, the overpaid amount becomes a clawback that we may deduct from your future payouts or reasonably request back.

5. Payouts

  • Payouts are sent manually, out-of-band (e.g. PayPal or bank transfer), to the payout contact you provide. It is your responsibility to keep that contact accurate.
  • Only matured commissions (past the 30-day hold and not reversed) are paid. Amounts still clearing the hold, or that have been reduced or reversed, are not included.
  • Payouts are processed once your balance of matured commissions reaches a minimum threshold of €25 (or the equivalent in your payout currency). Balances below the threshold roll over to the next payout cycle until it is met.
  • If your affiliate account remains inactive for more than 12 consecutive months and your balance stays below the payout threshold, any unclaimed commission may be forfeited.
  • You are solely responsible for any taxes owed on amounts you receive. We may request tax or identity information where required by law, and may withhold payouts until it is provided.
  • Commissions have no cash value except as an amount payable to you under these terms, and are not transferable.

6. How you may promote

You agree that, when promoting SurgeFPS, you will:

  • Promote honestly — no false, misleading, or exaggerated claims about SurgeFPS, its performance, its pricing, or its features.
  • Disclose that you earn a commission where required (for example, an “affiliate” or “#ad” disclosure), consistent with applicable advertising and consumer-protection rules.
  • Not spam, and not send unsolicited bulk messages, on any platform to distribute your code.
  • Not bid on, or use in paid advertising, the SurgeFPS name, trademarks, or confusingly similar terms, and not present yourself as SurgeFPS or an official channel of it.
  • Not use bots, fake accounts, cookie-stuffing, incentivized fake sign-ups, or any scheme to generate artificial referrals; and not attempt to combine, alter, or misrepresent the discount.
  • Comply with all applicable laws and the terms of any platform you post on.

7. Changes, suspension & termination

  • We may change the program at any time — including discount rates, commission rates, the reward window, the hold period, and these terms — on a forward-looking basis. Changes take effect when posted here; continued use of your code after that means you accept them.
  • We may deactivate your code, withhold or reverse commissions, and end your participation at any time, with or without notice, including for violation of these terms, suspected fraud or abuse, or if we discontinue the program.
  • You may stop participating at any time by ceasing to use your code and asking us to deactivate it.
  • On termination for cause (fraud, abuse, or breach of Section 6), unpaid commissions may be forfeited.

8. No guarantee

The program is provided “as is”. We do not guarantee any level of earnings, referrals, availability, or that the program will continue. To the extent permitted by law, SurgeFPS is not liable for indirect, incidental, or consequential losses arising from your participation, and our total liability for the program is limited to commissions actually owed to you.

9. Governing law

These terms, and any dispute arising out of or in connection with the affiliate program, are governed by and construed in accordance with the laws of Belgium, without regard to its conflict-of-law principles. The courts of Belgium have jurisdiction over such disputes, except where mandatory law grants you rights or a forum that cannot be waived.
