Terms of Service
Last updated: August 17, 2026
These Terms govern your access to and use of the SurgeFPS application and website. By downloading, installing, or using SurgeFPS, you agree to these Terms.
1. The service
SurgeFPS is a commercial trade name operated under enterprise/VAT number BE2388358447 ("SurgeFPS," "we," "us"). SurgeFPS is a Windows application that applies configurable system optimizations ("tweaks"), manages system modes, and provides related tools and monitoring. Some features are free; others require a paid subscription ("Pro" or "Ultra").
2. Eligibility & accounts
- You must be at least 16 years old, or the age of digital consent in your country, to create an account.
- You are responsible for your account credentials and for all activity under your account.
- You agree to provide accurate information and to keep it up to date.
3. License
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use SurgeFPS on computers you own or control. You may not resell, redistribute, rent, reverse engineer (except where that restriction is prohibited by law), or remove any proprietary notices from the software.
4. Subscriptions & billing
Paid tiers are billed through our payment processor on a recurring basis. Details of pricing, renewal, cancellation, and refunds are set out in our Payment Terms, which form part of these Terms. Pro features are licensed for concurrent use on a limited number of devices per your plan.
5. Acceptable use
You agree not to:
- Use SurgeFPS for any unlawful purpose or in violation of any applicable law;
- Circumvent, disable, or tamper with licensing, device limits, or security features;
- Interfere with or disrupt the service, its servers, or its networks;
- Use the software on systems you are not authorized to modify.
6. System changes, restore points & your responsibility
SurgeFPS modifies Windows settings, the registry, services, power configuration, and related system state. While SurgeFPS is designed to be reversible — it captures prior state and can optionally create a Windows System Restore Point before applying tweaks — you use these features at your own risk. Results vary by hardware and configuration, and we cannot guarantee any specific performance outcome. We strongly recommend maintaining your own backups. You are responsible for deciding which changes to apply to your system.
7. Disclaimers
SurgeFPS is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the software will be error-free, uninterrupted, or that it will produce any particular increase in performance, frame rate, or reduction in latency.
8. Limitation of liability
To the maximum extent permitted by law, SurgeFPS and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or system availability, arising from your use of (or inability to use) the software. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.
9. Termination
You may stop using SurgeFPS and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms. On termination, your license ends and Pro features will revert; changes already applied to your system remain reversible from within the app where supported.
10. Service communications & feedback requests
As part of providing and maintaining SurgeFPS, we may send you service and service-quality communications. These include transactional messages (such as account, security, licensing, and update notices) and occasional feedback or review invitations — for example a one-time request to review your experience with SurgeFPS. These communications are part of operating and improving the software and are distinct from promotional marketing. You may opt out of feedback and review invitations at any time via the unsubscribe link they contain or in your account settings, without affecting your access to the software. Certain essential transactional messages are required to operate your account and cannot be opted out of while your account remains active.
11. Your feedback & review license
If you choose to publicly post a review, testimonial, rating, or similar feedback about SurgeFPS (whether on a review platform such as Trustpilot, on social media, or elsewhere), you grant SurgeFPS a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, display, quote, and distribute that public feedback — including your public display name — for marketing, promotional, and product-improvement purposes. We will not alter the substance of your feedback in a misleading way. This license applies only to feedback you have already chosen to make public; it does not cover your private communications, and you remain the owner of your content. You can ask us to stop featuring a specific piece of your feedback in our own marketing by emailing [email protected].
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date, and where appropriate we will notify you. Continued use after changes take effect constitutes acceptance.
